CHARGE:
Driving while under the influence.
SUMMARY
Client was pulled over for DWI and the breath test machine was malfunctioning. The police then asked if she would take a urine test. Because of recent developments in caselaw, police need a warrant for urine tests. We filed a motion to suppress the test because the police did not inform her that refusal to take a urine test is not a crime without a warrant.
CASE DISPOSITION
The Court agreed with our position and suppressed the test result. We were able to have our client plead to a speeding violation.
